Court proceedings are often seen as a last resort, but when a Suspicious Activity Report (SAR) has been made, and consent to transact refused, they can be a route for customers to unlock funds informally "frozen" by Guernsey's consent regime. 

Karen Le Cras and Richard Field of Carey Olsen take us through developments in the law, discuss whether the consent regime is fit for purpose and consider the steps that can be taken to protect FSBs, both in terms of anticipating problems and in the event that proceedings are brought.
